Businesses that own or operate Automated Teller Machines (ATMs) must follow certain laws. These laws are enforced by the New York State Department of Financial Services (DFS).
Businesses may need to provide nighttime lighting, locking doors, and video surveillance. ATMs in buildings not used as banks do not need to fully comply, as long as the ATM is only available during normal operating hours.
DFS inspects ATM locations and fines businesses that are in violation of the law.
